Terms of Service
These terms govern the web design, hosting and support services provided by Project Forward Technologies Ltd ("Project Forward", "we", "us"), registered in England & Wales under company number 16873528. By engaging us or using a website we host, you ("the client", "you") agree to these terms. The specific scope and price of any project are set out in a separate written quote or proposal, which forms part of our agreement.
1. Our services
We provide custom website design, hosting, and ongoing maintenance and support as described in your quote. Any work outside the agreed scope may be subject to an additional charge, agreed with you in advance.
2. Quotes and payment
- Fees are as set out in your written quote (for example a one-off design fee and/or a recurring hosting and support fee).
- Recurring fees are billed in advance for each period (for example monthly or annually) as stated in your quote.
- Invoices are payable within 14 days of the invoice date unless otherwise agreed in writing.
- We may suspend a website or services where an invoice remains unpaid after a reasonable reminder.
3. Preview before you pay
Where we produce a design or preview of a new website, that preview is provided so you can decide whether to proceed. No design or hosting fee is due for simply viewing a preview; fees apply once you agree to proceed as set out in your quote.
4. Hosting and maintenance
Websites are hosted on Google Firebase infrastructure. We aim to keep your website available and secure but do not guarantee uninterrupted service, as some factors (such as third-party infrastructure) are outside our control. Ongoing support covers reasonable updates, changes and maintenance as described in your plan.
5. Your responsibilities
- Provide the content, information and access we reasonably need to carry out the work.
- Ensure you own, or have permission to use, any text, images, logos or other materials you supply.
- Use your website and our services lawfully and not for any unlawful or harmful purpose.
6. Intellectual property
Once you have paid all fees due, you own the content and the finished website design specific to your business. We retain ownership of any underlying tools, frameworks, code libraries and general know-how we use across projects. We may display your website and name in our portfolio and marketing unless you ask us in writing not to.
7. Cancellation and termination
Either party may end an ongoing hosting and support arrangement by giving 30 days' written notice. On termination, recurring services will stop at the end of the paid period. On request, we will provide a reasonable export of your website content. Fees already paid are non-refundable except where required by law.
8. Limitation of liability
We provide our services with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or consequential losses, loss of profit, or loss of business or data. Our total liability arising from the services is limited to the fees you have paid to us in the 12 months before the claim. Nothing in these terms limits any liability that cannot be limited or excluded under law (such as for death or personal injury caused by negligence, or for fraud).
9. Governing law
These terms are governed by the laws of England & Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England & Wales.
10. Changes to these terms
We may update these terms from time to time. The current version will always be published on this page with a revised "last updated" date.
