Terms of Service

These terms govern the web design, hosting and support services provided by Project Forward Technologies Ltd ("Project Forward", "we", "us"), registered in England & Wales under company number 16873528. By engaging us or using a website we host, you ("the client", "you") agree to these terms. The specific scope and price of any project are set out in a separate written quote or proposal, which forms part of our agreement.

1. Our services

We provide custom website design, hosting, and ongoing maintenance and support as described in your quote. Any work outside the agreed scope may be subject to an additional charge, agreed with you in advance.

2. Quotes and payment

Fees are as stated in your quote or proposal. The one-off setup fee is due before the website goes live on your domain. The monthly hosting and maintenance fee is collected by recurring card payment via Stripe. If a recurring payment fails, we will attempt to contact you to resolve the matter. If payment remains outstanding for more than 30 days, we reserve the right to temporarily replace your website with a holding page until payment is received.

3. Preview before you pay

Where we produce a design or preview of a new website, that preview is provided so you can decide whether to proceed. No design or hosting fee is due for simply viewing a preview; fees apply once you agree to proceed as set out in your quote.

4. Hosting and maintenance

Websites are hosted on either Google Firebase or Cloudflare infrastructure, at our discretion. Both platforms provide enterprise-grade hosting with global content delivery networks (CDN), SSL encryption, and high availability. We aim to keep your website available and secure but do not guarantee uninterrupted service, as some factors (such as third-party infrastructure) are outside our control. Ongoing support covers reasonable updates, changes and maintenance as described in your plan. This includes text changes, photo updates, and minor layout adjustments. It does not include new pages, major redesigns, or new functionality, which may be quoted separately

5. Your responsibilities

You agree to provide accurate information about your business, including contact details, services, and coverage areas. You are responsible for the content you provide and must ensure it does not infringe any third-party rights. You agree to respond to our requests for content and approval in a timely manner. If you have an existing website or domain, you authorise us to manage DNS and hosting configuration on your behalf.

6. Intellectual property

Once you have paid all fees due, you own the content and the finished website design specific to your business. We retain ownership of any underlying tools, frameworks, code libraries and general know-how we use across projects. We may display your website and name in our portfolio and marketing unless you ask us in writing not to.

7. Domain names

Where we register a domain name on your behalf, you are the legal registrant and owner of that domain. We manage the DNS and technical configuration through our Cloudflare account. If you choose to leave our service, we will transfer the domain to a registrar of your choice via an IPS tag change at no cost. Domain renewal fees are included in your monthly hosting fee.

8. Cancellation and termination

Either party may end an ongoing hosting and support arrangement by giving 30 days' written notice. On termination, recurring services will stop at the end of the paid period. On request, we will provide a reasonable export of your website content. Fees already paid are non-refundable except where required by law. If you cancel, you may transfer your domain to another provider at no cost.

9. Limitation of liability

We provide our services with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or consequential losses, loss of profit, or loss of business or data. Our total liability arising from the services is limited to the fees you have paid to us in the 12 months before the claim. Nothing in these terms limits any liability that cannot be limited or excluded under law (such as for death or personal injury caused by negligence, or for fraud).

10. Data protection

We process personal data (name, phone number, email) provided via your website's contact form and store it securely on cloud infrastructure (Google Cloud and/or Cloudflare) within the EU. We do not share your data with third parties except as required to provide our services (e.g. Stripe for payment processing, Google and Cloudflare for hosting). You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us at hello@projectforward.co.uk.

11. Governing law

These terms are governed by the laws of England & Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England & Wales.

12. Changes to these terms

We may update these terms from time to time. The current version will always be published at projectforward.co.uk/terms with a revised "last updated" date.
